Public Right-of-Way
West Chester Township secures public right-of-ways according to Ohio Revised Code 5571.14.
Property owners are not permitted to install or position personal items within the public right-of-way, including:
- Basketball hoops or athletic equipment
- Sprinkler systems
- Boulders and other features
- Signs including those advertising garage sales or open houses.
- Water directed from sump pumps, etc.
The right-of-way is protected in this manner for a variety of reasons. Primarily for the safety of motorists and residents. Placement of play equipment in the right-of-way encourages children to play in the road which presents a dangerous situation. Placement of large boulders and other items in the right-of-way can impair visibility for motorists. Secondly, various jurisdictions and agencies are responsible for maintaining some items which are permitted in the right-of-way such as, street signs, utilities, curbs and roadways.
West Chester Township is not responsible for unauthorized work within the right-of-way or on any Township property. This includes work related to sump pump lines, culverts, ditches, landscaping, etc.
If a resident is uncertain of their responsibility regarding the public right-of-way, they should contact West Chester Township Community Services - Roads Division at (513) 777-8765.
