Community Services - Right-of-Way

 

West Chester Township secures public right-of-ways according to Ohio Revised Code 5571.14.

Property owners are not permitted to install or position personal items within the public right-of-way, including basketball hoops, athletic equipment, sprinkler systems, boulders and other features. Signs are also not permitted in the right-of-way including those advertising garage sales or open houses. Furthermore, property owners are not permitted to direct water from sump pumps, etc. into the right-of-way.

The right-of-way is protected in this manner for a variety of reasons. Primarily for the safety of motorists and residents. Placement of play equipment in the right of way encourages children to play in the roadway which presents a dangerous situation. Placement of large boulders and other items in the right of way can impair visibility for motorists. Secondly, various jurisdictions and agencies are responsible for maintaining some items which are permitted in the right-of-way such as, street signs, utilities, curbs and roadways.

West Chester Township is not responsible for unauthorized work within the right-of-way or on any Township property. This includes work related to sump pump lines, culverts, ditches, landscaping, etc. If a resident is uncertain of their responsibility regarding the right-of-way, they should contact West Chester Township Community Services - Roads Division at 777-8765.
